Are CBD Edibles Legal in Canada?
The Cannabis Act made the selling of cannabis legal in October 2018. An amendment to this act will allow the sale of edible cannabis, cannabis extracts, and cannabis topicals beginning October 17, 2019. The business must be a provincial-territorial retailer or federally licenced seller of medical cannabis.
The Task Force on Cannabis Legalization and Regulation cautions people that products may be slow to enter the market. Businesses will need to meet licensing and regulatory controls before sales can begin.
Providing Canadian adults with legal access to several cannabis products will achieve Governmental objectives. This legislation will help to decrease the illegal market. Also, the Government aims to take illegal profits away from criminals and organized crime.
Why Start Business Planning Before Legislation Is in Effect?

What Licence Do You Need to Produce Cannabis?
Before October 2019, you must hold a Micro or Standard Processing Licence to produce cannabis oil. Under the new Cannabis Regulations amendments, you will also need this licence to manufacture edibles, concentrates, and topicals.
Previously, businesses conducting cannabis research and delivery vehicles had to get a Dealer’s Licence (DL) from the Narcotic Control Regulations.
With the new legislation, the facility will no longer receive a DL. Instead, companies will now get a Research and Development Licence to conduct experimentation. They may conduct research but are not allowed to sell any cannabis products.
The new policy requires physical growing facilities to be licensed to handle cannabis. The rule now states you must have a “fully built site that meets all the requirements of the Cannabis Regulations”.
This must be in place at the time of your application. These regulations will greatly restrict the manufacture of cannabis products.
What Licence Do You Need to Sell Cannabis?
The Access to Cannabis for Medical Purposes Regulations (ACMPR) currently regulates licensing rules. Further regulation falls under the Narcotic Control Regulations to the Controlled Drugs and Substances Act.
As of October 2019, the licence regulations are as follows:
License for sale: This allows for the sale of cannabis plants, seed, fresh or dried cannabis, or cannabis oil to medical users.
Cannabis drug licence: This authorizes the possession, sale, or distribution of cannabis containing drugs.
